This is the real question behind the search, so here is the evidence instead of a reassurance. The largest public study of enterprise generative AI in 2025, the MIT NANDA report The GenAI Divide: State of AI in Business 2025, surveyed executives and frontline users across 52 organizations and analyzed more than 300 public implementations. Its executive summary is blunt about what separates the winners from everyone else:

The same report measured the funnel: 60% of organizations evaluated enterprise grade AI tools, 20% reached a pilot and 5% reached production. It also found that projects run with outside specialists succeeded in 67% of cases against 33% for those built in house. McKinsey measured the same gap from the other side in November 2025: 88% of companies already use AI in at least one function, and 6% see material impact on the bottom line. What law covers your data when the work happens in Mexico?

Mexico rewrote its private sector data protection regime in 2025. The Federal Law on the Protection of Personal Data Held by Private Parties was published in the Diario Oficial de la Federacion on March 20, 2025 and took effect on March 21, 2025. Three things changed that matter to a foreign buyer:

• The regulator is different. INAI was dissolved and enforcement for the private sector moved to the Secretaria Anticorrupcion y Buen Gobierno.
• The privacy notice is the center of gravity. Whoever holds the data has to tell the data subject what it is used for, from the moment it is collected.
• The route of defense changed. Amparo before specialized judges replaced the nullity trial before the federal administrative court.

• Ask what is already in production. Not pilots, not demos. Systems that people used last week.
• Ask who operates it after handover. The failure mode is not a bad build, it is an orphaned one.
• Ask who keeps the code, the credentials and the data. Get the answer in the written scope before anyone starts building.
• Ask how adoption is measured. If the answer is a usage dashboard nobody reads, you are buying the 95% outcome.
